Fair use and terms of service

We keep legal agreements as simple and transparent as the technology. By connecting your store to Trusteed, you accept these fair-use principles, designed to sustain a healthy ecosystem between merchants and AI agents.

CHANGES IN THIS REVISION

Expanded clause 4: it cited only Shopify and WooCommerce as the merchant-of-record's backend, while the Privacy Policy already declares integrations with PrestaShop, Odoo, and Magento. A merchant on any of those three read a liability clause that didn't name them.
Rewrote clause 7: now describes the headers the service actually emits on each surface, instead of a single header the primary surface doesn't send.
Corrected the Art. 50 reference: applicable from August 2, 2026, and cited Regulation (EU) 2026/1744 amending the AI Act.

Access requirements: you must be at least 18 years old and acting on behalf of a registered business. By creating an account you confirm you meet these requirements.

1. Your store, your rules

You retain full intellectual property over your catalog, your images, and your brand. Trusteed acts as pass-through infrastructure - the bridge - that lets AI agents read your public data and suggest items to users.

2. Acceptable agentic use

You agree not to use our gateway to intermediate malicious payloads, manipulate transactions, or sell illegal goods. We reserve the right to cut the connection with stores that violate global e-commerce compliance standards.

3. Service availability and usage limits

Because AI traffic scales unpredictably, beta and free-access accounts are subject to reasonable use limits to prevent network degradation. Higher dedicated throughput can be enabled within an approved commercial deployment, not through a public catalog of self-serve plans.

4. Limitation of liability

While we guarantee secure transmission of checkout payloads, final liability as the merchant of record remains yours, through the backend of whichever platform you use — Shopify, WooCommerce, PrestaShop, Odoo, or Magento. Trusteed is not liable for order fulfillment failures or chargebacks.

5. Liability cap

As a B2B SaaS, our maximum aggregate liability is strictly limited to the fees you actually paid in the 12 months prior to the incident. If you use a free beta or an unpaid access agreement, liability is capped at €100. We are not liable for indirect damages or lost profits.

6. Financial independence of the AI agent

We provide the MCP protocol but do not control the underlying language model. If you choose to disable human-in-the-loop confirmations, you expressly assume 100% of the financial risk from AI hallucinations or erroneous actions.

7. Transactions initiated by AI agents

Transactions processed through Trusteed's Agent API may be initiated by artificial intelligence agents acting on behalf of human users. These transactions are identified through response headers, in compliance with Art. 50 of Regulation (EU) 2024/1689, as amended by Regulation (EU) 2026/1744, applicable from August 2, 2026.

The headers issued depend on the surface:

X-Agent-Commerce and X-AI-Act-Transparency on the Agent API, the MCP gateway, and checkout tools.
X-Initiated-By: ai-agent on A2A surfaces - agent card, tasks, messages, and push notifications - and on outbound webhooks.

Coverage status per surface, including those still pending these headers, is published and kept up to date on the Compliance page.

Merchants receiving orders through MCP integrations acknowledge that buyers may include automated agents. This does not affect the legal validity of transactions.

8. Independence and force majeure

We are not liable for interruptions caused by force majeure, including failures of external cloud providers, outages of language model providers, or unavailability of third-party commerce platform APIs.

On dispute resolution: in jurisdictions where legally enforceable, you agree to resolve disputes individually and waive class actions. In Spain and the European Union, local procedural law applies, and that waiver is limited to the extent permitted by mandatory rules.

9. Data processing agreement

When you process end-buyers' personal data through Trusteed - shipping addresses, order details - we act as your processor under Art. 28 GDPR. By accepting these terms at signup, you also accept our processing agreement, which governs data minimization, security measures, the sub-processor list, breach notification, and safeguards for international transfers (standard contractual clauses or a data privacy framework). The list of sub-processors and the international-transfer safeguards do not need to be requested: they are published in section 15 of the Privacy Policy.

10. Cancellation and refunds

You can cancel your beta access or commercial service agreement at any time from the merchant panel or by contacting support. If you're on a paid commercial deployment, billing, the refund window, and renewal terms are governed by the commercial terms confirmed for your account. Public beta access is free and may be withdrawn or paused at any time.

11. Obligations when activating third-party payment protocols

When you activate payment processing protocols through Trusteed, you take on the following obligations:

Maintain a privacy policy that discloses Stripe and PayPal as payment processors, and that states PayPal acts as an independent data controller.
Maintain a clear returns policy, with conditions, timelines, and procedures.
Provide a customer support channel accessible from your store.
On Stripe Connect, acknowledge that funds flow directly from the customer to your connected account and that Trusteed does not intermediate those payments.
Remain responsible for disputes and chargebacks as the merchant of record.

Failure to meet these obligations may result in suspension of payment processing capabilities.
